1. SCOPE
1.1 These General Terms and Conditions (GTC) apply to orders placed through the Bienvenue Design Studios GmbH online shop, as well as to the contractual relationships arising therefrom between Bienvenue Design Studios GmbH (hereinafter "Bienvenue Studios") and its customers.
1.2 The offer is aimed at private individuals and businesses worldwide. Mandatory statutory provisions of the respective country of residence or stay of consumers remain reserved.
1.3 By submitting an order, the customer accepts these GTC in the version published at the time of the order.
1.4 The customer's deviating terms and conditions apply only if Bienvenue Studios expressly agrees to their validity.
2. OFFER AND CONCLUSION OF CONTRACT
2.1 The presentation of products in the online shop generally constitutes an invitation to place an order. It is not a binding offer unless expressly stated otherwise.
2.2 Before submitting the order, the customer has the opportunity to review the selected products, quantities, prices, and delivery details and to correct any input errors.
2.3 By submitting the order, the customer makes a binding offer to purchase the selected products.
2.4 The automatic order confirmation initially serves to inform the customer that the order has been received. The purchase contract is concluded once Bienvenue Studios expressly accepts the order, for example by issuing a corresponding order confirmation, or upon shipment of the ordered goods.
2.5 Bienvenue Studios reserves the right to reject or cancel orders if products are unavailable, there is an obvious price or system error, there is a reasonable suspicion of fraud, or the order cannot be fulfilled for legal or technical reasons. In such cases, payments already made for unfulfilled orders will be refunded.
3. PRODUCTS AND PRODUCT PRESENTATION
3.1 Bienvenue Studios offers printed products and merchandise. The specific offer and the essential characteristics of the products are set out in the respective product descriptions in the online shop.
3.2 Product images are for illustrative purposes. Color variations due to different screen settings and minor production-related deviations may occur, provided that the agreed product characteristics are not substantially impaired thereby.
3.3 All copyright, trademark, and other intellectual property rights in the designs, graphics, photographs, texts, and other content provided by Bienvenue Studios remain with the respective rights holders. The purchase of a product does not transfer any further usage rights unless expressly agreed otherwise.
4. PRICES AND PAYMENT TERMS
4.1 The prices stated in the online shop at the time of the order apply. Price information, the treatment of value added tax, and any other applicable taxes are subject to the applicable statutory provisions and the respective sales arrangement.
4.2 Shipping costs and other costs incurred during the ordering process will be shown before the order is finalized, insofar as they can be determined at that time.
4.3 The available payment methods are displayed at checkout. These may include credit card, PayPal, TWINT, and, if enabled in the shop, bank transfer.
4.4 Payments will be processed in accordance with the selected payment method and the applicable terms and conditions of the respective payment provider. The customer undertakes to provide the information required for payment processing correctly and completely.
4.5 Unless otherwise agreed, the purchase price is due upon ordering. If advance payment is agreed, the order will be processed once payment has been received.
4.6 In the event of late payment, statutory provisions apply. Proven, reasonable costs incurred due to culpable late payment may be claimed to the extent permitted by law.
4.7 For international payments, currency conversions or additional fees from the payment or financial service provider may apply depending on the payment method. Bienvenue Studios will only charge such fees if they are legally permissible and are disclosed accordingly in advance.
5. DELIVERY AND SHIPPING
5.1 Bienvenue Studios delivers worldwide, provided that the respective delivery destination is offered in the online shop.
5.2 A flat shipping rate displayed at checkout will be charged for each order. The flat shipping rate will be shown before the order is finalized. Additional shipping costs will only be charged if they are transparently stated before the order is placed.
5.3 Orders are generally processed within 1–2 business days. The delivery time after shipment is usually 2–12 business days, depending on the delivery region and shipping service provider. These figures are estimates and not binding delivery dates unless expressly agreed otherwise.
5.4 Additional costs may arise for deliveries outside the country from which the goods are shipped, in particular import duties, import taxes, customs clearance fees, and shipping service provider fees. These costs are not covered by the flat shipping rate and are to be borne by the customer unless Bienvenue Studios is legally required to cover them or they are expressly stated otherwise at checkout.
5.5 The customer is responsible for informing themselves about the import regulations of their country and paying any applicable import duties. Bienvenue Studios does not assume any additional import costs that were not expressly stated in the ordering process.
5.6 The customer is obliged to provide a complete and correct delivery address. Additional costs that can be proven to have arisen due to incorrect or incomplete address information may be charged to the customer to the extent permitted by law.
5.7 Delivery delays due to customs clearance, transport service providers, official measures, or other circumstances beyond the reasonable control of Bienvenue Studios may extend the delivery time. The customer's mandatory statutory rights remain reserved.
5.8 The transfer of risk in the event of loss or damage during transport is subject to the respective applicable statutory provisions. Mandatory consumer rights remain reserved.
6. REVOCATION, RETURNS, AND EXCHANGES
6.1 Customers in Switzerland
6.1.1 Under Swiss law, there is generally no statutory right of revocation for online purchases. A voluntary right of return for change of mind is only granted if Bienvenue Studios expressly guarantees this in the online shop.
6.1.2 Statutory claims for defective or incorrectly delivered products remain reserved.
6.2 Consumers in the European Union
6.2.1 Consumers generally have the statutory right to revoke the purchase contract within 14 days of receiving the goods without stating any reasons, provided that the statutory requirements are met.
6.2.2 Revocation may be effected by a clear declaration by email to hello@bienvenuestudios.com. Providing the order number will facilitate processing.
6.2.3 The customer bears the immediate costs of return, provided they were properly informed of this before the conclusion of the contract and that the assumption of these costs is legally permissible.
6.2.4 In the event of revocation, payments made will be refunded in accordance with the applicable statutory provisions. Bienvenue Studios may withhold the refund to the extent permitted by law until the goods have been returned or proof of return is available.
6.3 Customers in other countries
6.3.1 For customers outside Switzerland and the European Union, the mandatory statutory rights of revocation and return of the respective country apply, insofar as they are applicable.
6.3.2 Unless there is a mandatory statutory right of revocation or return, a return due to change of mind is only possible if Bienvenue Studios expressly guarantees this.
6.4 Returns and Complaints
6.4.1 In the event of damaged, defective, or incorrectly delivered products, the customer is requested to contact Bienvenue Studios as soon as possible at hello@bienvenuestudios.com and to document the situation with photographs.
6.4.2 Statutory warranty and other consumer rights remain unaffected. Prior contact serves to process the complaint efficiently and does not restrict these rights.
7. RIGHTS FOR DEFECTS AND LIABILITY
7.1 Bienvenue Studios fulfills the contractually agreed obligations in accordance with these GTC and applicable law.
7.2 In the event of defective or incorrectly delivered products, the customer has the rights arising from the applicable statutory provisions and the validly agreed contractual arrangements. The customer is requested to report any identified defects as soon as possible to hello@bienvenuestudios.com. Statutory time limits remain decisive.
7.3 In assessing a defect, the agreed product description, the guaranteed characteristics, and the nature of the product are particularly decisive. Normal, minor production or presentation deviations do not constitute a defect, provided they fall within the agreed specifications and are legally permissible.
7.4 Bienvenue Studios is liable to the extent permitted by law for damages caused by intentional or negligent behavior. Liability for indirect damages, consequential damages, or lost profits is excluded to the extent permitted by law.
7.5 The above limitations of liability do not apply in cases of intent, gross negligence, injury to life, body, or health, expressly assumed guarantees, or any other cases in which a limitation of liability is legally impermissible.
7.6 Bienvenue Studios is not liable for delays or failures to perform that are solely attributable to circumstances beyond the reasonable control of Bienvenue Studios, insofar as this provision is legally permissible. The customer will be informed of any significant impacts, insofar as this is reasonable. Mandatory statutory claims remain reserved.
8. DATA PROTECTION
8.1 Bienvenue Studios processes personal data in accordance with the applicable data protection provisions and the privacy policy published on the website.
8.2 Personal data may be disclosed to Shopify, payment providers, shipping service providers, and other commissioned service providers for the processing of orders, insofar as this is necessary for order processing, the operation of the online shop, or the fulfillment of legal obligations.
8.3 Further information about the data collected, its use, recipients, storage, and the rights of the data subjects can be found in the privacy policy.
9. INTELLECTUAL PROPERTY
9.1 All content provided by Bienvenue Studios, in particular designs, photographs, illustrations, texts, logos, and graphic elements, is protected by copyright or other intellectual property rights, provided that the statutory requirements are met.
9.2 The use of this content outside of normal private use requires the prior consent of the respective rights holders, unless statutory permission exists.
9.3 Unauthorized reproduction, distribution, publication, or commercial use may result in legal action.
10. APPLICABLE LAW AND JURISDICTION
10.1 Unless mandatory statutory provisions state otherwise, the contractual relationships are subject to Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
10.2 For disputes with business customers, Zurich, Switzerland, shall be the place of jurisdiction, insofar as legally permissible.
10.3 In contracts with consumers, mandatory statutory provisions regarding the applicable law, jurisdiction, and consumer protection of the respective country of residence remain reserved.
11. FINAL PROVISIONS
11.1 Should any individual provisions of these GTC be invalid or unenforceable, the remaining provisions shall remain in effect to the extent permitted by law. The applicable statutory provisions shall replace the invalid provision.
11.2 Changes and additions to individual agreements must comply with the legally prescribed form. Individual agreements take precedence over these GTC to the extent permitted by law.
11.3 The version of these GTC valid at the time of the order is decisive, unless mandatory statutory provisions state otherwise.
